1. Acceptance of Terms
By installing, accessing, or using the Alintro AI Upsell & Bundles application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.
2. Description of Service
Alintro AI Upsell & Bundles is a Shopify application that allows merchants to:
- Create product bundles with discounts
- Display bundle offers on product pages
- Track bundle performance and revenue analytics
- Receive AI-powered bundle recommendations
3. Account and Access
To use the App, you must have an active Shopify store and grant the App necessary permissions to access your store data. You are responsible for:
- Maintaining the security of your Shopify account
- All activities that occur through your account
- Ensuring your use complies with Shopify's Terms of Service
4. Subscription Plans and Billing
The App offers various subscription plans based on your store's bundle-generated revenue:
- Free Plan: Up to $500 revenue/month, limited to 3 bundles
- Growth Plan ($19/month): Up to $5,000 revenue/month, up to 10 bundles
- Scale Plan ($49/month): Up to $20,000 revenue/month, unlimited bundles
- Pro Plan ($99/month): Unlimited revenue and bundles, priority support
Billing is processed through Shopify's billing system. You authorize us to charge your payment method on file with Shopify for the applicable subscription fees.
5. Free Trial
New users may be eligible for a free trial period. At the end of the trial, you will be automatically enrolled in the Free plan unless you choose to upgrade.
6. Cancellation and Refunds
You may cancel your subscription at any time by uninstalling the App from your Shopify store. Upon cancellation:
- You will retain access until the end of your current billing period
- No refunds are provided for partial billing periods
- Your data will be deleted within 48 hours of uninstallation
7. User Responsibilities
You agree to:
- Use the App only for lawful purposes
- Not attempt to reverse engineer, decompile, or hack the App
- Not use the App to transmit harmful code or content
- Provide accurate information when creating bundles
- Comply with all applicable laws and regulations
8. Intellectual Property
The App, including its code, design, features, and documentation, is owned by Alintro and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the App for your Shopify store. You may not copy, modify, distribute, or create derivative works.
9. Data and Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of data as described in the Privacy Policy.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALINTRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR REVENUE, ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Alintro and its affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
13. Modifications to Service
We reserve the right to modify, suspend, or discontinue the App at any time, with or without notice. We may also update these Terms from time to time. Continued use after changes constitutes acceptance of the modified Terms.
14. Third-Party Services
The App integrates with third-party services including Shopify and AI providers. Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
16. Dispute Resolution
Any disputes arising from these Terms or use of the App shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class actions.
17. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
